Eleven Years of NY Personal Injury Litigation Boxed Away

Just in case you were wondering (and I’m sure you were), the photo on the left is what eleven years of litigation looks like.  I have blogged about this case before:  It took me eleven and a half years to finally get justice for nine Guatemalan and Mexican migrant farm workers who were injured in a big explosion in upstate New York.

The picture on the right was taken in a hotel in Guatemala where I brought the men to sign settlement papers and open bank accounts.

Eleven years of research (lots), depositions (more than thirty), motions (more than 20),  discovery (tons) and appeals (3).  It felt good — very good — to box it all up and put it into storage (where it will stay for seven years and then be shredded).

Do I feel guilty for killing so many trees?  Yes, a little.  But in my opinion, those trees gladly sacrificed themselves to the greater cause of bringing justice to my maimed, broken and burned clients.  (By the way, we at Michaels & Smolak store everything both electronically and in paper format.  But you still need the actual papers to try a lawsuit!)

After 11 years together, I have forged life-long relationships with these clients.  Even though their case is closed, and they have been paid, and their structured settlements are all set up, they still call me on my cell phone via “WHATS APP” or SKYPE just to chat and see how I am doing (I speak Spanish).

Today one of them called me to say “solo queria decirle licenciado lo agradecido que estoy por todo lo que usted hizo por nosotros” (“just to called to tell you Attorney Bersani how thankful I am to you for all you have done for us”.

Practicing law doesn’t get much better than this. . .
